Letter from James Cobb to John Simkins Esqr, Edgefield Ct House
Campbells Mills 18th Decer 1819
John Simkins Esqr
Dear Sir, I send you by Mr Simmons, the citatation[sic] executed as you directed also the appraisement of my Brothers property and my Bond. I find my Brothers Estate is oweing to the Bank of the State Four Hundred and Fifty five Dollars exclusive of Interest and I must petition you for leave to sell as much property for cash as will command that amount. I have been looking for a letter from Messrs Glasscock & Jeter, giving me Instructions how to act with the property willed by Mr Savage to his Daughter and her Heirs. As yet I have not had the pleasure of receiving a line from either of them. turn over
[other side of paper]
I have had the property appraised that I conceived to be my Brothers. I have been instructed that it is out of the question for me as administrator to do any thing with the property willed by Mr Savage as a foresaid, and that I must apply to the next Court of Equity and have a Guardian appointed who will be the only person legally authorised to take charge of Said property as it did not belong to my Brothers Estate. I deemed it unnecessary to have it appraised, Indeed the appraisers would not act on it. I wish to have the Sale of my Brothers Estate on Wednesday the 12th January next, if there Should be a Sale orderd[sic] in that neighbourhood on that day, you will please name Wednesday the 19th of that month. I will thanks[sic] you to deliver the order of Sale to Mr Simmons--do mention to Messr Glasscock & Jeter I am very anxious to receive a letter from both of them, and I think it a little strange they have not complyed[sic]with their promise. I am very respectfully your Hbl Sr.

To John Simkins Esquire, Ordinary of Edgefield District
The humble Petition of George W. Martin one of the securities in the Bond ___ by James Cobb for his administration of Tho. Cobbs estate.
Sheweth that it has lately come to the knowledge of your petitioner, that in July __ at last a decree was in your Honorable Court rendered against the said James Cobb for a large balance appearing to remain unadministered in his hands:
that your petitioner has understood that the said James Cobb was on default in his appearance because of his having been ___ to affirm on a day different from the day when the account was taken--
and that in fact _____ the said James Cobb by payment satisfaction to ___ guardian of the two distributees of the Estate aforesaid had been wholy discharged from same which has been ordered against him.
Your petitioner ________ prays that the ___ aforsaid may be opined[?] & that after ____ to all the parties _________ __________ may be had to ascertain the liability of the said James Cobb & ____ securities to his administration Bond.

for Petitioner

Also written on the back of the petition is this statement by John Simkins, Ordinary of Edgefield District:
"In the Court of Ordinary
Edgefield District"
On hearing this petition I granted a citation to the Administrator returnable on some day ____ the last Spring Court of Common Pleas for this District, & Recd citation not being returned executed, I granted another citation to James Cobb & to Roger William, a security upon his guardianship bond returnable the 18 October 1830 & the matter being continued by a ___________ to this 20 October 1830, after argument I refused to entertain the motion to opening decree dated 5 Oct 1829 on the ground that appeal to the Common Pleas was the proper remedy to the party complaining, & that more than 20 days had elapsed from the date of my Decree.

Bobbie, I am most interested in your Samuel S. Cobb b.1806. Is his name Samuel Savage Cobb? I descend from Samuel Savage and Frances (Foote) Moore, Yarbrough, Savage by their daughter Frances, who married Thomas Herron and moved from Edgefield Dist. SC to Abbeville Dist. SC. They also had a daughter, Elizabeth who married first-Cullen Lark d.1805 and then she married Thomas Cobb.Seems like this could be their son. Have you probate on your Samuel S. who died ca.1815 in Abbeville? Where did Samuel b.1806 live between Edgefield or Abbeville and Texas? I have seen in Abbeville records where Edmund Cobb married Elizabeth Cheatham and James Cobb married Charlotte Campbell.Let me hear from you concerning your Samuel S. Sarah
